In a significant legal development, Google has agreed to a $700 million settlement with state attorneys general over allegations of excessive fees charged for app usage on its Play Store. The settlement, which was initially reached in September, was made public late Monday.

As part of the settlement terms, Google will allocate $630 million to a fund benefiting over 100 million consumers nationwide. An additional $70 million will be set aside for states to distribute to consumers with similar claims. Google’s Vice President of Government Affairs and Public Policy, Wilson White, announced in a blog post that as part of the settlement, Android users will now have the option to directly download apps, bypassing the Play Store entirely. This move aims to enhance choice and flexibility for users while maintaining robust security measures.
Automated Payouts for the Majority of Eligible Consumers
Approximately 70% of eligible consumers, totaling more than 71 million people, will automatically receive compensation without the need to file a claim. Eligibility criteria include having a legal address in their Google payments profile in the U.S., the District of Columbia, Puerto Rico, or the U.S. Virgin Islands, and making app purchases or in-app transactions through Google Play between August 2016 and September 2023.
Ongoing Antitrust Challenges for Google
While this settlement addresses one facet of Google’s legal challenges, the tech giant still faces antitrust scrutiny related to its app store and other business segments, including its search engine. Earlier this month, a California court ruled against Google in a case brought by Epic Games, asserting that the Play Store engaged in anticompetitive practices.

Epic Games, the maker of Fortnite, criticized the settlement, claiming it fails to address Google’s alleged unlawful and anticompetitive behavior adequately. The settlement follows a two-year investigation involving over 1,000 document requests and interviews with more than 40 individuals associated with Google. Settlement talks began more than a year ago and culminated in a tentative agreement on terms over the Labor Day weekend this year.
